Federal Judge essentially rules that landlords can evict people during the global pandemic

The United States continues to be a cold, heartless country, even as the nation and the world continue to stare in the face of a deadly global pandemic.

Wednesday, U.S. District Court Judge Dabney Friedrich ruled in favor of landlords vacating a nationwide freeze on evictions that was put in place by federal health officials at the CDC to help cash-strapped individuals and families during the COVID-19 pandemic.

Within the 20-page ruling, Friedrich determined that exceeded it’s own authority by enacting the nationwide ban.

“The question for the Court is a narrow one: Does the Public Health Service Act grant the CDC the legal authority to impose a nationwide eviction moratorium? It does not,” Friedrich wrote. 

A number of other judges have ruled on the eviction ban’s lawfulness, with landlords holding a slight advantage in its win-loss record against the federal government.

But while some judges have limited the scope of their rulings to apply only to the parties involved in the particular lawsuits before them, Friedrich rebuffed the federal government’s request that she narrow the effect of her decision, indicating its reach would be nationwide.

“The Department urges the Court to limit any vacatur order to the plaintiffs with standing before this Court. This position is at odds with settled precedent,” she wrote, citing prior court rulings.

It’s completely inconceivable that a nation that refers to itself as a proponent of freedom and justice at home and abroad would even consider a ruling like this. Likewise, because of this, families, children are going to be put out on the street, further putting themselves at risk not just to the dangers that lie there, but this deadly virus that despite a vaccine being available is still waging a brutal war on humanity.
